Terms of service

Terms and conditions

The following terms and conditions (hereinafter “the Terms”) apply when you, as a consumer (hereinafter “the Customer”), shop via www.fairwithhair.se (hereinafter “the Website”). By placing an order, the Customer accepts the Terms. The agreement is concluded between the Customer and Fairwithhair Josiander AB, company registration number 556839-6039 (hereinafter “Fairwithhair”). To shop on the Website, the Customer must be at least 18 years old. In accordance with Swedish law, Fairwithhair does not accept credit purchases by persons under the age of 18. Fairwithhair reserves the right to refuse the Customer’s order in individual cases, for example if the Customer has provided incorrect personal details or has payment defaults on record.

Fairwithhair reserves the right to sell out of items and accepts no liability for any image or typographical errors on the Website, for example errors in product descriptions, incorrect prices and price adjustments (such as changed prices from suppliers or currency fluctuations), or incorrect information about whether an item is in stock. Fairwithhair has the right to correct any such errors and to change or update the information at any time. Fairwithhair has made every effort to display the correct shades, but due to the colour settings of different screens, shades may sometimes be misleading.

If you have any questions or complaints, Fairwithhair asks the Customer to contact customer service at info@fairwithhair.se.

Prices and payment

The price stated always includes VAT. In addition to the price of the item, costs for delivery and payment method may apply, depending on the Customer’s choice. Information about the terms and prices for delivery and payment methods is clearly shown at checkout. Before the Customer confirms their order, the total amount of the order will be clearly displayed.

Card payment

At Fairwithhair, the Customer can pay with Visa, Mastercard or American Express cards approved for online shopping, via the DIBS payment gateway. No extra fees are charged. The relevant amount is reserved on the Customer’s card immediately, but is not charged until the goods have been shipped. The payment gateway (DIBS), through which all card payments are processed, meets the requirements of PCI-DSS. Fairwithhair reserves the right to check the validity of the payment card, that there are sufficient funds to cover the value of the order, and that the cardholder’s address details are correct. Fairwithhair may refuse a purchase on the basis of this information. www.dibs.se

Invoice and instalment payment

The Customer can choose to pay by invoice from Klarna. Klarna then carries out a credit assessment and in some cases a credit check. The Customer will then receive a copy of the credit check by post. Klarna also checks that the details provided by the Customer match their Swedish personal identity number (personnummer) and registered address. Paying via Klarna is safe and simple, and the Customer never needs to enter their card details.

The payment term is 14 days from the invoice date, and you have the option to pay in instalments. You can log in at klarna.se to see your invoices. When the Customer chooses to pay via Klarna, Klarna’s terms and conditions apply.

Deliveries

At checkout, the Customer can choose from the available delivery options and see which delivery times apply. Fairwithhair always strives to have all our products in stock. If a product is not available for immediate delivery, this is clearly stated on the product and at checkout. If certain parts of the Customer’s order cannot be delivered immediately, the Customer is welcome to contact Fairwithhair’s customer service for help arranging a partial delivery or finding a similar item. If Fairwithhair is unable to meet the agreed delivery time because the item has sold out, Fairwithhair will contact the Customer. If the parcel has not arrived, the Customer must notify Fairwithhair of this within 14 days of the order date. The Customer may cancel the purchase free of charge if Fairwithhair does not fulfil the delivery terms. During major holidays, festive seasons and traffic disruptions, the Customer’s parcel may be delayed. Please note that changes to deliveries may occur in connection with public holidays.

When an order leaves our warehouse, the Customer receives an email saying that the item(s) are on their way. To track the parcel, the Customer can contact customer service for the parcel number and search for the parcel on PostNord’s website, www.postnord.se. For questions about or problems with the delivery, PostNord can be reached on 0771-33 33 10, where the parcel number must also be given.

Delivery of dangerous goods

Some of Fairwithhair’s products contain flammable substances and are therefore subject to delivery restrictions. This applies, for example, to solvents for hair glue. These products are covered by special delivery agreements, which means that the transport of the parcel cannot be handled in the same way as other products. These deliveries are made with “Mypack Home”. PostNord will then contact the Customer to choose a day for home delivery. The parcel is delivered on the chosen day between 08:00 and 17:00. On delivery, the Customer must be able to show identification. If another person receives the parcel, they must be able to show both their own and the Customer’s identification. If no one is at home to receive the delivery on the agreed day, a notification is sent with information about where the parcel can be collected. The Customer can also book a new delivery with PostNord, but an extra fee will then apply.

If the Customer wishes to return or exchange products containing flammable substances, the Customer must also be aware that special transport requirements apply, and follow them.

If the Customer does not collect their parcel

The Customer’s parcel remains at the pick-up point for 14 days from notification. Items that are not collected within this period are returned to Fairwithhair. For items that the Customer has ordered but not collected within the specified time frame, the Customer will be charged the costs of return shipping plus a processing and handling fee. These costs currently amount to 300 SEK.

Returns, right of withdrawal and complaints

Shopping with Fairwithhair should feel safe. That is why Fairwithhair of course complies with the Swedish Act (2005:59) on Distance Contracts and Off-Premises Contracts (Lagen om distansavtal och avtal utanför affärslokaler, the Swedish Distance Contracts Act). This means that the Customer always has the right to withdraw from their purchase and, in the event of any defects, to make a complaint about the item. When exercising the right of withdrawal, the Customer pays the shipping costs for returning the item and is responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature and characteristics of the item. In the event of a complaint because the Customer has received an incorrect or defective item, Fairwithhair will refund the full return shipping cost.

Right of withdrawal

Please note that the right of withdrawal does not apply once the seal on hair extensions, hair care or skin care products has been broken. Nor does the right of withdrawal apply to goods that have been made to the Customer’s specifications or that have otherwise been clearly personalised. Exceptions are also made for certain other goods, for example sale items, but this is then stated in connection with the product description.

When exercising the right of withdrawal, the Customer pays for the return shipping and is responsible for the condition of the item after receiving it and during return shipping. The item must be sent well packed, in good condition (unused, and without having been soiled or damaged), with the label unbroken and in its original packaging. Returns must be made to Fairwithhair in accordance with the methods and instructions stated on the Website.

Fairwithhair guarantees to make a refund or, if the Customer so wishes, to exchange the item in accordance with the right of withdrawal. The full item is refunded provided that it is returned in untouched condition (the same condition as when it was delivered to you). This means that the goods must not have been damaged, soiled, washed, altered or worn, and that any tags and labels are intact. If the item is in an altered condition, an assessment of its diminished value will be made. The diminished value is not refunded.

RETURNS / Right of withdrawal / Exchange (summary)
All returns must be sent back and have reached us within 14 days of receipt, as follows:
Pack the item (still sealed) carefully in the same package/bag it came in. Alternatively, use your own packaging/box.
Send the packing slip together with your order to: Fairwithhair Josiander AB, Box 6077, 102 32 Stockholm, Sweden
Hand in the parcel at your nearest post office. Keep the receipt, as the post office gives you a tracking ID.

Complaints

The right to complain covers goods that are defective under applicable consumer protection legislation. If the Customer believes that a product is defective or faulty, the Customer can make a complaint about the item. For Fairwithhair to be able to assess the item complained about, the entire item must be returned, together with a detailed description of the fault and how the item has been used. If the entire item is not returned, Fairwithhair cannot make a complete assessment of the fault. Fairwithhair can only assess and, where applicable, refund the part that has been returned.

In the event of a complaint, the Customer must contact Fairwithhair as soon as possible after discovering the fault, using the contact details stated on the Website. Complaints made within two months of the Customer discovering the fault are always considered to have been made in good time. The Customer has a 3-year right to complain about goods purchased on the Website.

Complaints about the installation of hair must be made to the person or salon that carried out the work, who is therefore responsible for the work having been carried out correctly. Unfortunately, Fairwithhair cannot compensate the costs the Customer has incurred for the installation of the hair, or if the hair has been damaged in connection with this.

Fairwithhair reserves the right to reject a complaint if it turns out that the item is not defective under applicable consumer protection legislation. In the case of complaints, Fairwithhair follows the guidelines of the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN). More information is available at www.konsumentverket.se (the Swedish Consumer Agency).

Refunds

When the Customer withdraws from their purchase, the amount the Customer paid for the item is refunded. The Customer does, however, pay the shipping costs. In the case of a complaint, Fairwithhair also refunds an amount corresponding to the standard shipping cost. Express shipping, or shipping that is not standard, is not refunded. Where the Customer only partially cancels the order and keeps parts of it, no shipping cost is refunded.

If you have received a defective item, you must notify Fairwithhair of this immediately and return the item in accordance with the return information above. For items assessed as defective, Fairwithhair makes a full refund, including the cost of return shipping. Where a service has been started, the right of withdrawal applies to the remaining part of the service that has not yet been started.

Fairwithhair has the right to deduct from the amount to be refunded a sum corresponding to the item’s diminished value compared with its original value, if and to the extent that such diminished value is due to the Customer having handled the item more than was necessary to establish its nature, characteristics or functioning.

Fairwithhair will refund the amount as soon as possible, and at the latest within 14 days of the date on which the Customer’s notice of withdrawal was received, provided that Fairwithhair has received the returned item. The refund is made via the payment option the Customer chose, unless otherwise agreed or there is an obstacle to such a refund.

Warranty

Some of Fairwithhair’s goods may be covered by a warranty. Information about any warranty period and specific warranty terms for each item can be found on the Website or in these Terms. The warranty for goods only covers original defects existing at the time of delivery, and therefore not defects arising from incorrect handling or after the Customer’s own alteration of the item’s function or appearance.

Privacy policy

Personal data

Fairwithhair cares about the Customer’s personal privacy and always strives to protect all personal data in the best possible way. Fairwithhair intends to comply with all laws and regulations on personal data protection in force at any given time. A more detailed description of Fairwithhair’s privacy policy is available as a separate document on the Website. This policy describes what information Fairwithhair collects, for what purpose and how it is used. It also provides information on how the Customer can access stored information and have it deleted. By accepting the policy on the Website in connection with a purchase or when providing information, the Customer consents to the processing of personal data in accordance with this policy.

Fairwithhair Josiander AB, 556839-6039, Box 6077, 113 24 Stockholm, Sweden, is the data controller for the processing of the Customer’s personal data.

Where the Customer has chosen to pay via Klarna, the Customer has also entered into an agreement with Klarna, to which Klarna’s rules on personal data processing apply. Fairwithhair has no responsibility for this agreement.

Force majeure

Fairwithhair is not liable for delays caused by circumstances beyond Fairwithhair’s control, such as general labour disputes, war, fire, lightning, terrorist attacks, changed regulations by public authorities, technical problems, faults in electricity, telecommunications or data connections or other communication, and faults or delays in services from subcontractors due to any circumstance stated here. Such circumstances shall constitute grounds for exemption, releasing Fairwithhair from liability for damages and other sanctions. Should such a situation arise, Fairwithhair will inform the Customer both at the beginning and at the end of the period during which the situation lasts. If the circumstance has lasted for more than two months, both the Customer and Fairwithhair have the right to cancel the purchase with immediate effect.

Changes to the Terms

Fairwithhair reserves the right to make changes to these Terms at any time. All changes to these Terms will be published on the Website. Changes take effect once the Customer has accepted the Terms (in connection with a new purchase or when visiting the Website), or 30 days after Fairwithhair has informed the Customer of the changes. Fairwithhair does, however, recommend that the Customer checks the Website regularly to stay informed of any changes to the Terms.

Invalidity

Should a court, public authority or arbitration board find that any provision of these Terms is invalid or unenforceable, the provision in question and all other provisions shall remain valid and enforceable to the extent permitted by applicable law. Provisions declared invalid or unenforceable will be replaced by relevant legal guidance and advice.

Applicable law and disputes

If a dispute cannot be resolved amicably with Fairwithhair’s customer service, the Customer can turn to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN). More information is available at www.arn.se. The Customer can also submit a complaint directly online to the European Commission’s platform for online dispute resolution, via the following link: http://ec.europa.eu/consumers/odr. If you submit a complaint via this platform, your case is automatically forwarded to the competent national dispute resolution body. That body then contacts Fairwithhair and tries to resolve the dispute without involving the courts.

Disputes concerning the interpretation or application of these Terms shall be interpreted in accordance with Swedish law and settled by the Swedish National Board for Consumer Disputes (ARN) or, as a last resort, by a court of general jurisdiction.
